Disability Accommodation Policy & Procedures

Austin Kade Academy will be referenced as School or The School throughout this document.

1) Purpose & Non-Discrimination

Austin Kade Academy (“The School”) complies with the ADA and Section 504 and provides equal access to programs, services, and activities for qualified students with disabilities.
The School does not discriminate on the basis of disability in application, acceptance, grading, advancement, training, discipline, graduation, or participation.
Reasonable accommodations are provided when they do not fundamentally alter program requirements or create an undue burden.

2) Definitions

Disability: A physical or mental impairment that substantially limits one or more major life activities.
Reasonable Accommodation: A modification or service that enables equal access without lowering standards.
Interactive Process: A collaborative discussion to determine appropriate accommodations.
Documentation: Professional records verifying a disability and need for accommodations.

4) Student Responsibilities

Submit a written request to Student Services.
Provide current documentation from a qualified professional.
Participate in the interactive process.
Requests should be made before the program begins.

5) School Responsibilities

Respond in a timely manner.
Maintain confidentiality.
Provide approved accommodations and notify instructors as needed (without sharing medical details).
Provide written notice if a request is denied, including appeal information.

6) Accommodation Process

Step 1: Student submits request.
Step 2: Student provides documentation.
Step 3: Review and meeting to determine appropriate accommodations.
Step 4: Written decision issued within two weeks of request or documentation receipt.
Step 5: Instructors notified.
Step 6: Accommodations implemented.

7) Fundamental Alteration / Undue Burden

The School is not required to provide accommodations that fundamentally alter essential program requirements or impose an undue financial or administrative burden.

9) Confidentiality

Disability records are confidential and shared only on a need-to-know basis.

10) Appeals

Written appeals must be submitted within 10 business days of a denial.
A written decision will be issued within 14 business days. The decision is final.

11) Non-Retaliation

The School prohibits retaliation against anyone requesting accommodations or filing an appeal.
